| 大家好，现在有一问题想向大家请教： 我们要求非洲肯尼亚一客人开保兑信用证，但是其开出的信用证没有ＣＯＮＦＩＲＭＡＴＩＯＮ Ｌ／Ｃ 字样，应该不属于保兑信用证，但是在开过来的信用证中４９条这样写到49：Confirmation Instruction : Confirm （49．保兑指示：保兑） 因为非洲人信誉一向不好，我们要求客人请中国银行做为保兑行，并且客人请信用证中作为偿付行的美国运通银行出具了一份note of understanking（应该是相当于***之类的东西吧）呈交给中国银行， 但是中国银行拒绝作为其保兑行．现在美国运通银行对非洲客人的邮件回复如下：
Dear mike, (ＭＩＫＥ为客人名称） It is unfortunate that we have received such a reply. As per my understanding this may be the Bank of China’s policy not to confirm LCs. I therefore request that you apply the two options below; You request the beneficiary to take the reimbursement undertaking from our American Express New York as enough proof that they will be paid as per the LC terms, since the undertaking constitute the guarantee to pay on fulfillment of the conditions set in the LC and in the undertaking. This is more or less the same as the confirmation of the LC. The other option will be to cancel the LC and allow us to use Commerzbank Shangai who will accept to confirm the LC. The implication of this is that, the Amex Ny reimbursement undertaking charges may not be refunded and will still be borne by the beneficiary in addition to the Commerzbank confirmation charges.
