| | 客户发来了一个dradt contract,里面有提到一个performance bank guarantee, 是银行担保么? 怎么还要是印度的一家银行开? 属于信用证里的么? 请***们指点一下
11. PERFORMANCE BANK GUARANTEE
SELLER shall furnish to BUYER a Performance Bond in the form of a
Performance Bank Guarantee in the format as mentioned in ANNEXURE IV of the contract, within 7 (seven) days from the date of contract signing. The amount of the Performance Bank Guarantee shall be for 10% (ten percent) of the total contract price i.e. US$ *域名隐藏* (United States Dollars xxxxxxxxxxxxxxxxxxxxxx only) The Performance Bank Guarantee shall be opened at a First Class Bank in India and advised through Sumitomo Mitsui Banking Corporation, Singapore by SWIFT telex, guaranteeing full compliance by SELLER of all its obligations under this Contract. This Performance Bank Guarantee shall be valid up to 12 (twelve) months after the issuance of Final Acceptance Certificate or 18 (eighteen) months after the last and final invoiced delivery of the GOODS in Yangon whichever is earlier.

| PERFORMANCE BANK GUARANTEE,履约银行保函,一般大型机械\设备贸易或工程招投标中使用较多!
你们是SELLER还是BUYER?----客户要求印度一流银行出具,并且经过Sumitomo Mitsui Banking Corporation, Singapore通知(by SWIFT telex),不知道为什么!可以具体跟客户确认啦!

| 多谢油条大哥.我们是SELLER,现在问题是价格上谈不拢,这单做不成了,因以前没有接触过此类问题,所以能否再麻烦你给我多解释一下,做不成的生意我也不好意思问客户,谢谢了.
p.s.产品为电动机,可能对客户来说是大型设备,所以需要这个GUARANTEE

| 既然你们SELLER,应该要求中国的银行出具保函-----这里要求"印度银行出具"保函,可能是客户使用以前的合同格式,忘记修改啦,没有什么特殊的意义!
-----这种履约保函在大型设备\工程招投标中经常使用!比如大型设备,一般客户要求根据卖方开出的履约保函支付定金或者合同约定的预付款,保函有效期通常为1年左右.
合同实际履行后,正本保函(如果出的话)必须要求客户退还并退回出具银行才能撤保(即使超过有效期也要退回!)由于履约保函具备"见索即付"的性质,一般银行对于出具这种保函都比较慎重,记得中国***外管局曾对这种涉外担保***过专门的政策和规定,如果一定要接受这样的条件的话,***先跟你们的银行确认能否出具这样的保函!
