| Additional conditions:
1. insurance to be covered by applicant
2. drawings under combined dc not allowed
3. usd 75/cad 100(or equivalent)per set of documents/per shipment plus all relevant cable charges will be deducted from each negotiation of discrepant documents under this documentary credit. Nothwithstanding any instruction to the contrary, these charges shall be for the account of the beneficiary.
4. in case of dc expired or dc overdrawn, a handling commission of 1/8 pct of invoice value (min usd 50.00/cad 75.00) will be for account of beneficiary and shall be deducted from proceeds.
5. unless otherwise expressly stated, all documents called for under the credit must be in the language of the credit. The drafts. Invoices and transport docs must quote this doc. Credit no,. issuance date and name of issuing bank.
6. all documents called for under this credit, except those which the credit specifically states can be “copies” must be originally signed (or) clearly marked on their face as “original”.
7. all documents to be forwarded in one lot by courier at beneficiary’s expense to hsbc bank Canada , Montreal trade services center, 2nd floor ,500 rene-levesque west, Montreal. Quebec, Canada h2z 1w7.
8. nothwithstanding article 48 and article 9d (iii), at the time of presentation of the documents the beneficiary must include a certificate noting those amendments to the credit that the drawing is make in accordance with, if this credit is not amended such certificate is not required.
9. it is a condition of this credit that for each drawing/presentation under this credit covering more than three shipments, we will view each set of documents as a separate presentation, a charge of usd50.00 or equivalent for each additional set of documents presented will be deducted from proceeds
10. Nothwithstanding the provisions of ucp500,if we give notice of refusal of documents presented under this credit we shall however retain the right to accept a waiver of discrepancies from the applicant and, subject to such waiver being acceptable to us , to release documents against that waiver without reference to the presenter provided that no written instructions to the contrary have been received by us from the presenter before the release of the documents, any such release prior to receipt of contrary instructions shall not constitute a failure on our part to hold the documents at the presenter’s risk and disposal, and we will have no liability to the presenter in respect of any such release.
11. presentation of documents(s) that are not on their face in compliance with applicable anti-boycott, anti-terrorism and anti-money laundering laws and regulations is not acceptable. Applicable laws may include united nations and local laws.
12. please present an extra copy of all documents for issuing bank’s records and retention
13. except so far as otherwise expressly stated this doc credit is subject to uniform customs and practice for doc. Credits(1993 revision) icc publication 500. the reimbursement under this doc credit is subject to uniform rules for bank to bank reimbursements, icc publication 525.
14. details of chares: all chrg outside issuing bk + reim/remitting chrg for a/c bene
15. period for presentation: within 007 days after the date of shipment but within the validity
