| 请帮忙翻译一下,该合同条款,不胜感激.
1.For latent defects, A CO***NY’s liability is limited to claims incurred by B CO***NY from third party final customers for injury/damage to their property which arise solely from A CO***NY failure to manufacture product according to cGMP and the Specifications along with B CO***NY’s reasonable out of pocket expenses in the event of recall, and only where recall is required by applicable laws or customary industry practice.
2.Parties will not be liable for the other’s indirect, consequential or economic loss (including loss of profit, earnings, business), nor for losses of this nature incurred by other third part
3.A CO***NY’s overall contractual liability to be capped financially in relation to the value of the material sold.
4.Liability limitations remain subject to applicable law

| 1.对于(产品的)潜在缺陷,A公司的责任仅限于B公司由于A公司未能按照cGMP要求和规格生产产品所直接引起的\第三方***终客户财产伤害和损失导致的索赔,以及B公司在需要招回时垫付的\合理的费用,但(采取的)招回措施仅限于根据适用的法律的要求和商业实践中的惯例.
2.相关各方不负责其他方间接的\派生的以及经济上(包括利润\收入和业务)的损失,也不包括本来可能产生利益的第三方的损失.
3.A公司全部合同责任与销售原料的价值关连,不得超过所销售原料的价值. CAPPED,我理解为上限,不超过的意思!
4.相关的责任范围条款仅限于根据适用的法律有效.

| CAD=CASH AGAINST DELIVERY，跟D/P AT SIGHT还是有区别的！
----不过都是客户的商业信用，风险方面基本差不多！
