我国***目前实行的是监企合一体制。在国际国内新形势下，改革现行***体制，实现***职能归位和***企业***健康发展已是当务之急。监企分开的必然性在于：***走向现代化的***正确选择是***职能单一化；***的困难通过体制改革才能解决；实施刑罚存在执法漏洞更需要***体制改革；监企合一体制不利于保障罪犯的合法权益；监企合一不符合市场经济原则。
Nowadays, the Prison Management System (PMS) operating in China is the prison-organization syncretism system. However, according to the international and domestic trends in the new PMS development, it is urgent to reform the in use system and realize the separation of the prison and the prison-related organizations. The inevitabilities of the separation of the functions of prison and the organization are as follows:
1. Fully achieved prison’s functions are the critical paths leading to the modernization of PMS;
2. Many current difficulties in the PMS can be solved through the reform of the system;
3. The deficiencies lying in the implementation of punishment are also asking for transformation of the present system;
4. The prison-organization syncretism system has created some disadvantages towards to ensure the prisoners’ legal rights;
5. The prison-organization syncretism system does not match the principles of the market-oriented Economy these days. 监企分开体制如何构建？国外监企分离的成功经验可资借鉴；监企分开的基本模式是：***专司***管理，完善确保提高改造罪犯质量的机制，确保新体制下***职能的纯化；企业建立法人治理结构，切实解决好***与企业特殊关系问题。
How to construct a prison-organization discerption system then? We can learn from other countries’ successful experiences on separating the prison and the prison-related organizations. The basic model of it is including:
1. The prison is in charge of the prison management on its own.
2. The prison aims to play an instrumental role in the correction and rehabilitation of inmates under its care, to enable them to return to and integrate with society.
3. It makes sure the purification of the prison’s functions under the reformed system.
4. The organizations establish the distinct legal entities – corporations.
5. In particular, this model has to resolve the special relationship between the prison and the organization. 规范新体制下的***企业运行，是改革成败的关键和难点，需注意几个问题：建立规范监企关系的机制；规范企业组织运作机制；规范企业财务运作机制；规范企业考核运作机制；规范企业日常运作；构建利于***企业运行的法律机制。The key point and difficulty of this reform are how to run the prison-related organizations in the new system. There are a few problems we have to concern of:
1. Setting up a standardized prison-organization separation system.
2. Regulating the framework operations in the organizations.
3. Regulating the accounting system in the organizations.
4. Standardizing the organization appraisal system.
5. Regulating the daily operations in the organizations.
