The base price shall be increased/decreased by /for each 1% Fe above /below 63.5% fraction prorata.

Byuer has the right to reject the cargo if Fe content is below 63%.

Clause 6.B.  For other elements
 
           If the shipment does not meet any of the chemical specifcations other than Fe provided in CLAUSE 4 as finally determined in accordance with the provisons of the CLAUSE 10 ,the base price shall be decreased as follows fraction prorata.

Clause 6.B.i    For excess phosphorus
              At the rate of 5 (Five)US Cents per dry metric ton for the each 0.01% in excess of 0.06%.
Clause 6.B.ii    For excess Sulpher
              At the rate of 5(Five)US Cents per dry metric ton for the each of 0.01% in excess of 0.03%
Clause 6.B.iii   For excess Sllice
              At the rate or 5(Five) US Cents per dry metric day metric ton for the each 1.00% in excess of 4.00%

The weight of each shipment at the discharge port is to be ascertalned by draft survey .Seller ,would at their option ,depute their representative or nominate agency at their cost to witness operations .The weight thus no draft survey is performed at discharge port ,Seller¡¯s load port weight  cerificate will be regatded as final.

The dry quantity shall be detemined by deducting the free molsture referred to in CLAUSE 10 from such wet quantity .If the differences of weight overrun 0.5% compared to B/C  Quantity ,then Buyer and Seller may consultation ,the mean figure of the two figures from loading port and discharge port shall be fine.

Clause10.Sampling And Analysis:

       Clause10.A. At the loading poat ,Seller shall at Seller¡¯s expense,detemine the specfications of Ore contained in each shipment and shall provide a certificate issued by Empanelled Inspection Agency showing detalls of the determination and also the percentage of free molsture loss at 105 degree centigrade .Buyer if felt necessary .would depute their repreations or nominated at their cost to witness operations at the loading port(s).Similar facllty would be extended to seller at the discharge port(s) in china.

At the port of discharge Buyer shall ,at Buyers expense,apply CIQ for samling & analysis,CIQ shall sample form each shipment and divide into three parts,one for Buyer ,the second for Seller and third for possible umpire anaysis which shall be sealed and kept whit CIQ.

CIQ shall analyse the sample for Buyer and Buyer shall within 60 days of discharge at discharge port promptly forward to Seller by airmail ,CIQ centificate showing the percentage of chemical contents ,the percentage of free moisture loss at 105 degrees centigrade and the relevant screen analysis .CIQ¡¯s analysis shall be final except as othenwise provided for in CHAUSE 10B.

Clause 10.B    Fe Content ,other chemical content and physical analysis:
              If the difference in percentage of content between Buyer¡¯s and Seller ¡®s analysis made under paragraph A of this CLAUSE is more than 0.5% or if there exists a significant difference between the two said annlysis in respect of any one or more chemicle contents except moisture ,Seller shall consult with Buyer to reconcile such difference .If after consultation between Seller and Buyer the difference cannot be reconclled  then at the request of Seller the sample for umpire  agreed between Buyer and Seller and the certificate of analysis issued by each umprie shall be final for Fe or relevant chemical content ,Seller shall consult with Buyer to reconcile the difference on physical analysis ,If after  consuitation between Seller anh Buyer the difference cannot be reconciled then at the request of Seller the umprire analysis for physical content will be undertaken using the physical analysis sample.

Clause 10.C.  If no determination of analysis is exercised at the port of discharge ,Seller¡¯s certificate of load port analysis shall be conclusive as to specification of one shall be Final Invoice.

Clause 10.D  Analysis:
            The weight ,samping and chemical analysis ,moisture determination and screen analysis performed at the discharging port by CIQ shall be for Buyer¡¯s account .The cost of umpire nanlysis shall be for the account of the party whose own analysis differs farther from the umpire analysis is the mean of the analysis of Buyer and the analysis of Seller,then such cost shall be equally by both parties.
