Expiration of Textile Quotas
Late Breaking Developments and Impact on Current Shipments

We are writing to apprise you of certain late breaking developments and issues stemming
from the expiration of textile quotas for WTO member countries at the end of this month and its impact on current shipments.

•Date of Export ¨C Quotas (and visa requirements) will expire with respect to goods exported from their country of origin on or after January 1, 2005. Thus, goods shipped from theircountry of origin in 2004 to an intermediate country from which they are shipped to the  *ÓòÃûÒþ²Ø*  2005 will still be treated as quota merchandise. This could apply, for example, to Chinese origin goods leaving China in 2004 for Hong Kong and then shipped therefrom in 2005. The same would be true for goods shipped in 2004 from Asia to Europe before shipment in 2005 to the U.S.
•Potential for Delays ¨C Related to the above, it is likely that Customs will closely scrutinize shipments arriving in the earlier part of 2005 to verify the actual date of export. In order to avoid delays, importers should require their suppliers to provide an onboard bill of lading for goods leaving directly from the country of origin or, in the case of goods transiting other countries, the applicable cross border document evidencing the date of departure from the country of origin.
•Recent OPA Operations ¨C Similarly, recent and ongoing Hong Kong / China OPA
operations (for example) need to be monitored for date of export issues. The dates on which the origin conferring operations are performed and the last date the goods leave their country of origin need to be carefully scrutinized. Thus, for example, Hong Kong origin goods leaving Hong Kong in 2004 for finishing operations in China in 2005 and then returning to Hong Kong for final exportation to the U.S. could, under appropriate circumstances, be regarded as 2005 exports. The same goods leaving directly from China would be considered 2004 exports (i.e., the last year the goods left their country of origin, Hong Kong), and,therefore, subject to quota.
•2004 Overshipments ¨C CITA has adopted a rather harsh policy with respect to goods
exported in 2004 in excess of existing quota levels and arriving in 2005. Specifically, such goods will essentially be frozen for the first month after the expiration of the quota.1 In each subsequent month, an amount representing only 5% of the base 2004 quota level will be allowed entry. Furthermore, it is anticipated that the staged entry quotas will be oversubscribed when they re-open with the result that importers may only receive a pro-rata allocation against the quantities presented for entry. This factor must be carefully considered in developing end of year shipment strategies.
•Textile Declaration/Quota Charge Statements ¨C Although the issue is under consideration,the requirements to file a single country, multicountry or negative textile declaration and a quota charge statement continue to apply for the time being.
•Chinese / Hong Kong Export Licenses ¨C As described below, as part of their export control processes, China and Hong Kong plan to utilize some form of export authorization document. U.S. Customs officials have indicated that these (or other associated documents)will not be treated as required entry documents but may be requested on an ad hoc basiswhen required for enforcement purposes.
•China Measures ¨C We understand that China is implementing a number of measures in this area. These reportedly include an export tax (structured to promote the exportation of more expensive categories of merchandise), an export authorization document and floor  *ÓòÃûÒþ²Ø*  floor pricing, export authorizations are only granted to companies selling their goods at or above certain minimum prices. Because of its potential impact on Customs value issues and U.S. cooperation with foreign countries¡¯ export regimes, this may be an area closely monitored by Customs. Thus, suspected circumvention of the Chinese rules by means of fictitious prices (on their face or through rebates, offsets, etc.) may result in denied entries or Customs enforcement actions.
For goods covered by the existing China safeguards under categories 222, 349/649 and 350/650, the current quota period extends through December 23, 2004. In virtually all other instances, the current quota period extends through December 31, 2004.
 
•Hong Kong Measures ¨C Although Hong Kong¡¯s textile licensing and documentation
requirements will become somewhat more relaxed in 2005, Hong Kong has announced that it will still require an Export Notification or Export License and a Production Notification (PN) for cut and sewn garments. Further, Hong Kong has indicated that, while not required, it will be in the importer¡¯s ¡°interest¡± to obtain a Certificate of Origin. For knit to shape garments processed outside of Hong Kong, Hong Kong will continue its existing documentation requirements (e.g., export notification, import notification and corresponding cargo manifests).
